ADC-cum-District officer of Gurugram issued a reminder for all establishment for POSH return. Under the Prevention of Sexual Harassment (POSH) Act, 2013, organizations in Gurugram must fulfil the critical requirement of submitting the Internal Complaints Committee (ICC) annual report to the District Officer. This report ensures transparency and compliance with workplace safety mandates.

Annual Deadline:

The ICC report must be submitted by February 28 every year. This applies to all organizations covered under the POSH Act and is non-negotiable.

What the ICC Report Must Contain:

  1. Details of Complaints:
    • Total number of complaints received during the year.
    • Cases resolved and actions taken.
    • Pending complaints, if any, along with reasons.
  2. Awareness Activities:
    • Sessions conducted to educate employees on POSH policies.
    • Measures taken to prevent sexual harassment.

Responsibilities of Employers:

To stay compliant, organizations must:

  1. Constitute the ICC:
    • Include a minimum of four members, with one external member as mandated.
  2. Raise Awareness:
    • Regularly train employees and make the POSH policy visible across the workplace.
  3. File the Report:
    • Ensure the ICC prepares and submits the report by the due date.

Consequences of Non-Compliance:

Failure to comply can result in penalties of up to ₹50,000, reputational damage, and possible legal scrutiny.

Preparing for February 28:

Organizations should act early to:

  • Review all complaints received in the year.
  • Document actions taken and outcomes.
